Trade Marks

Trade Marks can be one of the most valuable of property rights if selected and registered with the appropriate knowledge of how to obtain best enforceability. While most people can register a trade mark with IP Australia or the Intellectual Property Office of New Zealand the ability to maintain a trade mark and enforce it effectively requires a level of acumen that we offer. It is this very strategy that enables trade marks registered by Guy & Hinton to become potent tools for brand expansion and management.

Guy & Hinton applies for, opposes, bring non-use and removal applications, prosecute and defend trade mark matters in all forums in Australia and New Zealand. We apply for and prosecute international trade mark applications under the Madrid Protocol and work with Trade Mark Agents and Counsel in the prosecution and litigation of trade mark matters outside of New Zealand and Australia.

Guy & Hinton have acted for and against a number of parties before the Federal Court of Australia and lesser tribunals.. We take a very conservative approach to enforcement and defense of trade mark proceedings in the Courts and always retain Counsel who are regarded as being at the forefront of this area of law from the inception of the matter through to finality. This approach has been effective in generating successful results for our clients while minimizing risks which in this type of proceeding can be terminal for businesses.
