Guy & Hinton has acted for clients both offensively and defensively in the Federal Court of Australia in relation to actions involving the Trade Practices Act 1974 (Cth) and respective state Fair Trading legislation.

Most commonly, we have acted in misleading and deceptive conduct actions in the Federal Court. These actions are often in combination with common law passing off actions and trade marks infringement actions. We frequently advise clients on issues relevant to the combined issues of trade mark licensing, exclusive dealing and parallel importing.

Further, we advise clients in relation to issues including anti-competitive contracts arrangements and understandings; price-fixing and other cartels; monopolization and misuse of market power; anti-competitive mergers; resale price maintenance; and secondary boycotts affecting competition.

Guy & Hinton, through American based contacts, are able to obtain advice for clients in relation to the implications of American Anti-trust law under the Sherman Act in relation to business transactions with the United States.
