Confidential Information

In the absence of a contractual duty of confidentiality three elements are normally required to identify circumstances where a breach of confidentiality may have occurred.

It is possible to prevent the misuse of confidential information where that material has fallen into the hands of third parties following a breach of confidence. Courts have acted to restrain third parties from using or disclosing the information once they have actual or constructive notice of a breach.
